O dano existencial nas relações de trabalho

Abstract

Resumo: O presente trabalho pretende demonstrar sobre o Dano Existencial nas relações de trabalho. Analisando sobre sua ocorrência e os danos e prejuízos causados ao trabalhador nessa esfera extrapatrimonial, correspondente aos artigos 223-A e 223-G, da CLT. E apresentar julgados relacionados para tentar buscar mecanismos Constitucionais para evitar que ocorra sua crescente incidência ou até mesmo apresentar possíveis mecanismos de fiscalização a este male. Desta forma, visando assim à garantia efetiva da proteção dos direitos fundamentais do trabalhador previstos na Constituição.

Abstract: The present research intends to demonstrate about the Existential Damage in work relashionships. Analyzing its ocurrence about the damages caused to the worker in this extra-patrimonial sphere, corresponding to articles 223-A to 223-G, of the CLT. And about present related judgements to try to seek Constitutional mechanisms to prevent its growing incidence from ocurring or even present possible mechanisms of inspection to this injury. That way, ensuring the effective guarantee of the protection of the fundamental rights of the worker provided for in the Constitution.
