A responsabilidade civil do cirurgião-dentista : abordagem da harmonização orofacial

Abstract

Resumo: A responsabilidade civil é um instituto jurídico complexo que ganha contornos específicos na área da saúde, principalmente na odontologia e, mais recentemente, na nova especialidade odontológica Harmonização Orofacial. Com o aumento de procedimentos estéticos, torna-se fundamental estudar a responsabilidade civil do Cirurgião-Dentista, abrangendo temas como termo de consentimento livre e esclarecido, responsabilidade civil subjetiva e objetiva, Código de Defesa do Consumidor e como se aplica à pratica odontológica. O estudo tem como objetivo elucidar os principais aspectos da responsabilidade civil do Cirurgião-Dentista, com abordagem da Harmonização Orofacial. Busca-se analisar o entendimento doutrinário e jurisprudencial, sobre a natureza obrigacional imputada ao profissional. A pesquisa empregou o método dialético, utilizando técnicas de revisão bibliográfica e documental, além de analisar jurisprudências relacionadas ao tema. O estudo também se apoiou em dispositivos legais, para avaliar as responsabilidades inerentes à prática odontológica. Conclui-se que não há uniformidade na compreensão da natureza obrigacional do Cirurgião-Dentista, porém, em relação aos procedimentos estéticos, observa-se uma tendência crescente na doutrina e na jurisprudência para a caracterização de uma obrigação de resultado.

Abstract: Civil liability is a complex legal concept that takes on specific nuances in the healthcare sector, particularly in dentistry and, more recently, in the new dental specialty of Orofacial Harmonization. With the increase in aesthetic procedures, it becomes crucial to study the civil liability of the Dental Surgeon, covering topics such as informed consent, subjective and objective civil liability, the Consumer Protection Code, and its application to dental practice. The study aims to elucidate the main aspects of the civil liability of the Dental Surgeon, with a focus on Orofacial Harmonization. It seeks to analyze doctrinal and jurisprudential understandings concerning the nature of the obligation attributed to the professional. The research employed the dialectic method, using techniques of bibliographic and documentary review, as well as analyzing case law related to the topic. The study also relied on legal provisions to assess the responsibilities inherent in dental practice. It is concluded that there is no uniformity in the understanding of the nature of the obligation of the Dental Surgeon; however, concerning aesthetic procedures, there is a growing trend in both doctrine and case law to characterize it as an obligation of result.
