Discurso de Ódio : exercício de um direito ou limite à liberdade de expressão?

Abstract

Resumo: Práticas segregacionistas e discriminatórias se fazem presentes por toda a história e evolução social, mas o discurso de ódio propriamente dito e caracterizado na ideia que temos hoje, tem sido alvo de debate constante nas sociedades modernas. Apesar da consciência de que a liberdade de expressão é um direito de fundamental importância, que alicerça as sociedades democráticas e garante participação política e social aos cidadãos, é preciso reconhecer que o discurso de ódio vai além do exercício legítimo desse direito, afetando negativamente a convivência social e a vida privada das vítimas. A ascensão da internet e das redes sociais, que facilitam a disseminação do discurso de ódio, e o desenvolvimento da consciência e conduta da civilização para com o respeito às diferenças, aumentaram a visibilidade para o assunto e influenciaram na admissão social da necessidade de prevenir e repreender as práticas odiosas. Nesta toada, o presente Trabalho de Conclusão de Curso pretende analisar a temática do discurso de ódio como limite da liberdade de expressão, expondo os conceitos basilares e a forma com que a legislação e jurisprudência brasileiras tratam o assunto. Por fim, procura explorar as divergências que envolvem o assunto, como as teses de limitação da liberdade de expressão e a obscuridade que circunda o conceito do discurso de ódio, e apresentar sugestões para reprimir as práticas odiosas sem transgredir o direito à liberdade de expressão. A metodologia utilizada envolve revisão bibliográfica de literatura, documentos, legislação e jurisprudência.

Abstract: Segregationist and discriminatory practices have been present throughout the history and social evolution, but the concept of hate speech as we understand it today has been the subject of ongoing debate in modern societies. Despite the awareness that freedom of expression is a fundamental right that underpins democratic societies and ensures political and social participation for citizens, it is necessary to acknowledge that hate speech goes beyond the legitimate exercise of this right, negatively impacting social coexistence and the private lives of its victims. The rise of the internet and social media, which facilitate the spread of hate speech, and the development of societal consciousness and conduct regarding respect for differences have increased visibility on the subject and influenced social recognition of the need to prevent and condemn hateful practices. In this context, this Final Course Work intends to analyze the theme of hate speech as a limit to freedom of expression, outlining the fundamental concepts and how Brazilian legislation and jurisprudence address the issue. Finally, it seeks to explore the disagreements surrounding the topic, such as the arguments for limiting freedom of expression and the ambiguity surrounding the concept of hate speech, and to provide suggestions for curbing hateful practices without infringing on the right to freedom of expression. The methodology used involves a literature review of literature, documents, legislation, and jurisprudence.
