Práticas abusivas no tocante aos empréstimos consignados

Abstract

Resumo: O presente trabalho almeja versar acerca das práticas abusivas envolvendo os empréstimos consignados contra os consumidores mais vulneráveis. Procura retratar a história do direito do consumidor por um breve esboço, a estrutura e aplicabilidade da Lei 8.078/90, também denominado como Código de Defesa do Consumidor, e o seu direito comparado, alguns dos princípios fundamentais e presentes do direito consumerista, o conceito de relação de consumo e seus elementos, o entendimento de prática abusiva, tal como o rol elencado do artigo 39 do CDC, e a elucidação da modalidade de empréstimo consignado, suas práticas abusivas existentes e a pessoa idosa como a parte mais vulnerável da relação jurídica.

Abstract: This presente work aims to deal with the abusive practices involving payroll loans against the most vulnerable consumers. It seeks to portray the history of consumer law through a brief outline, the structure and applicability of Law 8.078/90, also known as the Consumer Protection Code and its comparative law, some of the fundamental and present principles of consumer law, the concept of consumer relationship and its elements, the understanding of abusive practices, such as the list listed in article 39 of the CDC, and the elucidation of the payroll loan modality, its existing abusive practices and the elderly person as the most vulnerable part in the legal relationship.
