O crime de estupro de vulnerável no atual ordenamento jurídico

Abstract

Resumo: Nesta pesquisa observa-se que, de todos os casos de violência contra crianças no Brasil, grande parte é caracterizada pelo estupro. O objetivo geral desta pesquisa é fazer uma análise do crime de estupro de vulnerável no atual ordenamento jurídico. Desta forma, a metodologia aplicada no presente trabalho se amolda em pesquisa bibliográfica, através de doutrinas renomadas do Direito Penal Brasileiro, artigos científicos, e pesquisa de julgados de Tribunais Estaduais e do Supremo Tribunal de Justiça, visando analisar a tese de que é possível a relativização do estupro de vulnerável, uma vez que a presunção é absoluta. Assim, conclui-se que, o abuso sexual na infância está associado a uma ampla gama de consequências adversas para os sobreviventes ao longo da vida. Até o momento, foram encontrados os vínculos mais fortes entre abuso sexual infantil e presença de depressão, abuso de álcool e substâncias, distúrbios alimentares para mulheres sobreviventes e distúrbios relacionados à ansiedade para homens sobreviventes. Um risco aumentado de revitimização de sobreviventes também foi demonstrado consistentemente para homens e mulheres sobreviventes.

Abstract: In this research it is observed that, of all cases of violence against children in Brazil, a large part is characterized by rape. The general objective of this research is to analyze the crime of rape of a vulnerable person in the current legal system. In this way, the methodology applied in the present work is shaped by bibliographical research, through renowned doctrines of Brazilian Criminal Law, scientific articles, and research on judgments from State Courts and the Supreme Court of Justice, aiming to analyze the thesis that it is possible to relativization of the rape of vulnerable people, since the presumption is absolute. Thus, it is concluded that sexual abuse in childhood is associated with a wide range of adverse consequences for survivors throughout their lives. To date, the strongest links have been found between childhood sexual abuse and the presence of depression, alcohol and substance abuse, eating disorders for female survivors, and anxiety-related disorders for male survivors. An increased risk of revictimization of survivors has also been consistently demonstrated for male and female survivors.
