Sistema de educação a distância como mecanismo de ressocialização no sistema prisional : uma análise jurídico-social

Abstract

Resumo: O presente trabalho tem como objetivo analisar como é oferecido aos apenados no Brasil o acesso à educação, uma garantia constitucional, com intuito de demonstrar como o ensino a distância tem eficácia no cumprimento desta obrigação estatal. O trabalho mostrará o cenário atual das penitenciárias brasileiras, com foco na alta taxa da população carcerária e de reincidência criminal, bem como será mostrado como o Poder Judiciário se posiciona diante deste modelo educacional dentro das penitenciárias e será destrinchado o funcionamento deste modelo educacional para melhor entendimento. Além disso, a problemática encontrada no Brasil será comparada a como é disciplinado o tema em territórios estrangeiros. O intuito do presente trabalho é demonstrar que o ensino a distância é umas das melhores opções para poder promover a educação, trazendo exemplos de alguns estados brasileiros que já se enquadrarem neste programa e vem obtendo grande resultados. O trabalho foi realizado através de pesquisas de materiais referentes à escritores, juristas renomados e portais reconhecidos em temas relacionados à Ensino a Distância como Mecanismo de Ressocialização, combinado com uma pesquisa, seleção e apresentação de decisões prolatadas em tribunais pátrios. Com o intuito de aproximar o tema da população foi pesquisado e apresentado os trâmites, informações necessárias e informações de auxílio, as quais um ente penitenciário que busca por se adequar a esta forma de ensino necessitará saber. É inegável a existência de lacunas na lei, bem como não há como se negar a falta de administração pública de qualidade. Também é necessário se afirmar que o tema apresenta evoluções, e como visto no desenrolar do trabalho, atualmente, é possível buscar acesso à implementação deste modelo de ensino, com a devida realização de uma tramitação burocrática. Analisando e visualizando a situação atual como um todo, a única coisa que é possível se afirmar com certeza é que a disseminação de informação é necessária, promover mais estudos e trabalhos sobre o tema é imperativo, e buscar maior incentivo do judiciário para atuação no tema é vital.

Abstract: This paper aims to analyze how inmates in Brazil are offered access to education, a constitutional guarantee, in order to demonstrate how distance learning is effective in fulfilling this state obligation. The work will show the current scenario of Brazilian penitentiaries, focusing on the high rate of the prison population and criminal recidivism, as well as showing how the Judiciary positions itself in the face of this educational model within penitentiaries and the functioning of this educational model will be unraveled for a better understanding. In addition, the problems encountered in Brazil will be compared to how the issue is regulated in foreign territories. The aim of this work is to demonstrate that distance learning is one of the best options for promoting education, bringing examples of some Brazilian states that have already been included in this program and have been achieving great results. The work was carried out by researching materials referring to writers, renowned jurists and recognized portals on topics related to Distance Learning as a Mechanism for Resocialization, combined with a search, selection and presentation of decisions handed down in Brazilian courts. In order to bring the subject closer to the population, the procedures, necessary information and supporting information that a prison seeking to adapt to this form of education will need to know were researched and presented. It is undeniable that there are gaps in the law, and there is no denying the lack of quality public administration. It must also be said that the subject is evolving, and as we have seen in the course of this work, it is currently possible to seek access to the implementation of this teaching model, with the necessary bureaucratic procedures. Analyzing and viewing the current situation as a whole, the only thing that can be said with certainty is that the dissemination of information is necessary, promoting more studies and work on the subject is imperative, and seeking greater encouragement from the judiciary to act on the issue is vital.
