O animal não humano no ordenamento jurídico brasileiro

Abstract

Resumo: Em razão da expressiva presença dos animais no cotidiano dos seres humanos, a presente monografia tem como escopo abordar as situações criadas a partir da interferência do ser humano na vida dos animais, bem como, a interferência dos animais na vida do ser humano, e os consequentes reflexos destas articulações no campo social, ambiental e jurídico. Dessa forma, pretende-se discorrer ao longo deste trabalho, os vínculos afetivos que o ser humano é capaz de estabelecer com um animal não humano e, a decorrente consideração moral nestes casos averiguada, em comparação ,com a exploração praticada contra outros animais, as razões pelos quais isso acontece, e ainda o contraste entre estas situações e, seus reflexos na proteção dos interesses jurídicos dos animais não humanos no Brasil. Para tanto, contará com a análise de entendimentos doutrinários do ramo do Direito Animal, decisões jurisprudenciais, legislações, projetos de lei, e declarações cientificas, atinentes ao tema abordado.

Abstract: Due to the significant presence of animals in the daily lives of humans beings, the present final paper has as purpose, to analyze the situations created by human interference in the lives of animals, as well as the interference of animals in the lives of humans, and the consequent impact of these interactions on the social, environmental, and legal fields. This final paper, intends to discuss the emotional bonds that humans can establish with non-human animals and the resulting moral consideration in these cases, in comparison to the exploitation practiced against other animals, the reasons why this happens,, the contrast between these situations and their reflections on the protection of the legal interests of non-human animals in Brazil. To do so, will be used as support the analysis of doctrinal views in the field of Animal Law, jurisprudential decisions, legislation, bills, and scientific statements relevant to the subject.
