Os novos requisitos econômicos para a concessão do BPC LOAS

Abstract

Resumo: O presente trabalho apresenta uma análise sobre os novos requisitos econômicos para a concessão do Benefício de Prestação Continuada - BPC. O benefício é um dos direitos sociais, integrante da Assistência Social, um dos pilares da Seguridade Social, junto com a Previdência Social e a Saúde. O BPC está garantido pela Constituição Federal de 1988 e regulamentado pela Lei nº 8.742/93, Lei Orgânica da Assistência Social - LOAS. Trata-se de um benefício individual, intransferível e não contributivo, que configura na garantia de um salário-mínimo mensal à pessoa deficiente e à pessoa idosa, com 65 anos de idade, ou mais, que comprovadamente residam no Brasil, que atendam aos novos requisitos econômicos de aferição da condição de miserabilidade e cumpram os demais critérios estabelecidos na lei.

Abstract: This work presents an analysis of the new economic requirements for granting the Continuous Payment Benefit - BPC. The benefit is one of the social rights, part of Social Assistance, one of the pillars of Social Security, along with Social Security and Health.
