Valor Jurídico do afeto : a possibilidade de responsabilidade civil na conjuntura do abandono afetivo

Abstract

Resumo: O presente trabalho visa explanar a problemática estabelecida no cenário atual oriunda do abandono afetivo nas relações parentais. Sob uma análise minuciosa da responsabilidade civil no ordenamento jurídico brasileiro, aqui irá ser discorrido o tema diante da possibilidade de indenização por danos morais frente às vítimas que tiveram que suportar os danos oriundos da falta de afeto. Do mesmo modo, tal perspectiva será debatida por meio da interdisciplinaridade no campo da psicologia que, conforme verá, mostrará a importância do afeto no ambiente familiar para a formação da prole e os eventuais riscos psicológicos que essa lacuna poderá causar, corroborando um possível dano passível de sua devida indenização.

Abstract: The present work aims to explain the issue established in the current scenario arising from emotional neglect in parental relationships. Through a thorough analysis of civil liability in the brazilian legal system, this topic will be discussed in relation to the possibility of compensation for moral damages suffered by victims who had to endure the harms resulting from the lack of affection. Similarly, this perspective will be debated through interdisciplinary approaches in the field of psychology, which, as you will see, will highlight the importance of affection within the family environment for the development of offspring and the potential psychological risks that this gap may cause, supporting the possibility of appropriate compensation for such harm.
