Um estudo acerca das pessoas vulneráveis : sob a ótica do Princípio da Dignidade da Pessoa Humana

Abstract

Resumo: Esta monografia intenta abordar o direito dos vulneráveis, aos quais estão previstos na Constituição Federal de 1988. A Constituição assegura, sob a forma de direitos fundamentais, o direito inerente a todos os cidadãos, que são: a justiça, a igualdade, a dignidade, segundo Gustavo Radbruch. O constituinte de 1988 já percebia o surgimento de classes minoritárias na sociedade brasileira, mas infelizmente não conseguiu impedir que alguns destes fossem marginalizados, como é o caso das minorias sexuais, como os transexuais e travestis, que serão abordados de forma mais explicativa no capítulo final desta monografia. Será percebido também que, ainda que seja considerável o avanço representado pela Constituição de 1988, o resultado dos avanços sociais obtidos através da promulgação desta Constituição não foi devidamente sentido, em termos de educação, saúde, emprego e demais itens sociais que correspondem ao conjunto que denominamos como direitos sociais, imprescindíveis para a integridade da dignidade da pessoa humana.

Abstract: This monograph intends to address the rights of the vulnerable, which are provided for in the Federal Constitution of 1988. The Constitution ensures, in the form of fundamental rights, the inherent right of all citizens, namely: justice, equality, dignity, according to Gustavo Radbruch. The 1988 constituent was already aware of the emergence of minority classes in Brazilian society, but unfortunately was unable to prevent some of them from being marginalized, such as sexual minorities, such as transsexuals and transvestites, which will be addressed in a more explanatory way in the final chapter. of this monograph. It will also be noticed that, although the advance represented by the 1988 Constitution is considerable, the result of the social advances obtained through the promulgation of this Constitution was not properly felt, in terms of education, health, employment and other social items that correspond to the set that we call them social rights, indispensable for the integrity of the dignity of the human person.
