Direito dos idosos : reflexo jurídico e social

Abstract

Resumo: Será demonstrado um breve estudo que, apesar de ser uma garantia constitucional, Direito do Idoso, pouco efetivamente se faz por eles neste país. Procuramos definir em relação ao envelhecimento físico e psicológico do ser humano, os vários tipos de idosos e seus principais problemas de saúde e de colocação na sociedade. Em seguida apresentamos a evolução histórica do direito à velhice que, já era previsto desde o Código de Hamurabi. Finalmente iremos discorrer sobre os princípios do Direito do Idoso, tais como: direito a vida, liberdade, cidadania, trabalho dentre outros. Descrevemos algumas legislações pertinentes e protetoras dos idosos, falamos de suas deficiências e de suas vantagens. Concluiremos com o pensamento de que esta questão dos idosos em nosso país deve ser amplamente discutida e tratada de forma mais concreta e eficaz, não se limitando somente as ideias atuais que são, de reconhecimento do direito de preferência em filas, gratuidade em transportes públicos etc.

Abstract: It will be demonstrated a brief study that, despite being a constitutional guarantee, the Elderly Law, is hardly done for them in this country. We seek to define in relation to the physical and psychological aging of the human being, the various types of elderly and their main health and placement problems in society. Below we present the historical evolution of the right to old age that had been foreseen since the Hammurabi Code. Finally we will discuss about the principles of the Elderly Law, such as: right to life, freedom, citizenship, work among others. We describe some pertinent and protective legislation of the elderly, talk about their shortcomings and their advantages. We will conclude with the thought that this issue of the elderly in our country should be widely discussed and dealt with more concretely and effectively, not only being limited to current ideas of recognizing the right of preference in queues, free public transport, etc.
