Legítima defesa : limites e excessos

Abstract

Resumo: O presente trabalha visa abordar a temática da legítima defesa, demonstrando que desde as civilizações mais antigas já possuíam uma modalidade de legítima defesa, abordando os limites da legítima defesa, o que é considera como excesso quando daquele ato, assim como se indica o que ocorre quando do excesso. Outro ponto que também será exposto neste trabalho são as classificações da legítima defesa, bem como cada hipótese de possível dolo ou culpa quando do excesso, as modalidades dos excessos, bem como serão apontados os tipos de legítima defesa indireta, àquela praticada através de objetos ou animais, que em um modo geral, visam a proteção patrimonial. Visando a melhor leitura e entendimento, uma melhor absorção do tema, serão expostos dois casos reais, e de grande repercussão na mídia, de legítima defesa, sendo um caso em que o apontamento da legítima defesa foi satisfatório, ou seja, foi acolhido e outro insatisfatório, ou seja, que não foi acolhido, ambos os casos resultaram na morte do agressor.

Abstract: The present work aims to address the theme of self defense, demonstrating that since the earliest civilizations already had a mode of self defense, addressing the limits of self defense, which is considered as excess when that act, as well as indicating what happens when over. Another point that will also be exposed in this paper are the classifications of self-defense, as well as each hypothesis of possible intent or guilt when excess, the modalities of excesses, as well as the types of self-defense indirect, to that practiced through objects or which, in general, aim at heritage protection. Aiming at a better reading and understanding, a better absorption of the theme, two real cases will be exposed, and of great repercussion in the media, of self defense, being a case in which the legitimate defense was satisfactory, that is, it was accepted and another unsatisfactory, ie not accepted, both cases resulted in the death of the aggressor.
