O princípio do contraditório na fase do inquérito policial

Abstract

Resumo: A pesquisa visa analisar, acerca da aplicabilidade ou não do princípio do contraditório previsto no artigo 5º, LV da Constituição Federal durante a fase préprocessual do inquérito policial. Abordar o conceito e principais características do inquérito policial observando quais direitos e garantias são estendidas ao investigado, para uma melhor compreensão sobre este procedimento que é de suma importância em nosso ordenamento jurídico. As variáveis que poderão interferir no processo de pesquisa e elaboração do trabalho de graduação são as legislações constitucionais e as infraconstitucionais vigentes, bem como as possíveis regulamentações ou mudança de entendimento pelos Tribunais superiores.

Abstract: The research aims at analyzing the applicability or not of the principle of the contradictory provided for in article 5, LV of the Federal Constitution during the reprocedural phase of the police investigation. To approach the concept and main characteristics of the police investigation observing which rights and guarantees are extended to the investigated, for a better understanding about this procedure that is of paramount importance in our legal system. The variables that may interfere in the research process and elaboration of the graduation work are the current constitutional and infraconstitutional legislations, as well as the possible regulations or change of understanding by the higher Courts.
