Serial Killers e o impacto no âmbito jurídico penal

Abstract

Resumo: A presente pesquisa tem como objetivo colocar sob análise duas vertentes inter-relacionadas: Medicina Legal, no que preze a psicologia e psiquiatria forense, e o Direito, abordando de forma crítica as características psíquicas dos Serial Killers e o tratamento legal oferecido a esses agentes no Brasil. Apesar de a indústria cinematográfica considerar os matadores em série como loucos, o instituto da psiquiatria forense os consideram agentes capazes, sendo necessária a responsabilização na medida de sua culpabilidade. A priori, a pesquisa busca explanar os métodos de identificação da sanidade mental, utilizados, por meio dos laudos clínicos e perícias psiquiátricas, no âmbito penal para medir a capacidade e periculosidade do agente. Ademais, é apresentada na pesquisa a técnica internacional mais adequada na investigação de possíveis Serial Killers: o perfil criminal. Por conseguinte, é exposto o instituto da responsabilidade penal, que abarca as características da culpabilidade e da medida de segurança. Em suma, a presente monografia, através da análise de caso e exposição da lacuna legal, busca elucidar a importância do Legislador em considerar a formulação de norma específica em face do Serial Killer, se atentando aos aspectos técnicos advindos da psicologia e psiquiatria forense.

Abstract: This research aims to put under analysis two interrelated aspects: Legal Medicine, with regard to forensic psychology and psychiatry, and Law, critically addressing the psychic characteristics of Serial Killers and the legal treatment offered to these agents in the Brazil. Although the film industry considers serial killers to be insane, the institute of forensic psychiatry considers them capable agents, and accountability is necessary to the extent of their culpability. A priori, the research seeks to explain the methods of identification of mental health, used, through clinical reports and psychiatric expertise, in the criminal scope to measure the agent's capacity and danger. Furthermore, the most appropriate international technique in the investigation of possible Serial Killers is presented in the research: the criminal profile. Therefore, the institute of criminal liability is exposed, which encompasses the characteristics of culpability and the security measure. In short, this monograph, through case analysis and exposure of the legal gap, seeks to elucidate the importance of the Legislator in considering the formulation of a specific rule in the face of the Serial Killer, paying attention to the technical aspects arising from forensic psychology and psychiatry.
