O sauté da dança em descompasso com a tutela autoral

Abstract

Resumo: O trabalho inicia-se com a evolução histórica do Direito Autoral, no Brasil e no mundo de forma a compreender as legislações pertinentes. Ainda, aborda as principais convenções internacionais em matéria de Direitos Autorais e as suas diferenças nos grandes centros, como América e Europa, ao longo dos anos. Apresenta as considerações doutrinárias e legislativa do Direito Autoral, principalmente ao que se refere ao tema no país. Seu surgimento, desenvolvimento até o que se conhece hoje como direito autoral e suas vertentes no território brasileiro. Apresenta ainda as artes, aprofundando o estudo em dança e suas modalidades, em especial os ballet de repertório. Por fim, apresenta a problemática envolvendo a dança e o direito autoral, pois há uma lacuna na legislação brasileira, e alguns conflitos em relação a forma correta de tutela desta arte, fazendo, inclusive um paralelo com a música que é uma das artes mais resguardadas pelo Direito Autoral hoje.

Abstract: The paper begins with the historical evolution of Copyright, in Brazil and in the world, in order to understand the relevant legislation on the theme. It focuses on the main international conventions on Copyright Law and its differences in great regions, like America and Europe, through the years. Furthermore, the article displays the doctrinarian and legislative considerations on Copyright Law, especially with regards to the subject in Brazil, analyzing its emergence, development, until what is currently known as "Author’s Rights", and its strands in the country’s territory. In addition, this work presents a brief view on the arts, deepening its study on dance and its modalities, mostly the repertoire ballet. Finally, the issue regarding dance and Copyright Law is discussed, in order to reveal a gap in the Brazilian Legislation and some conflicts relating to the correct tutelage of this art. To build the argument, a parallel with music, one of the arts most protected by Copyright today, is made.
