A vedação ao retrocesso dos direitos fundamentais sociais em tempos de clamor liberal econômico : direito à moradia

Abstract

Resumo: No presente trabalho de graduação, os temas discutidos serão os direitos sociais, sua evolução, em qual momento histórico surgiram e de que maneira são tratados na Constituição Federal de 1988. Abordar-se-ão o princípio da vedação ao retrocesso dos direitos sociais, o direito à moradia no seu aspecto evolutivo e o conflito entre o liberalismo econômico e a garantia desse direito pelo Estado. A intenção é elucidar desde as primeiras dimensões de direitos até a conquista dos direitos sociais, tendo em vista o momento histórico em que se tornou necessária a intervenção estatal a fim de tentar diminuir as desigualdades sociais.

Abstract: In this undergraduate work, the themes discussed will be social rights, their evolution, in what historical moment they arose and how they are dealt with in the Federal Constitution of 1988. The right to housing in its evolutionary aspect and the conflict between economic liberalism and the guarantee of this right by the State. The intention is to elucidate from the first dimensions of rights to the achievement of social rights, considering the historical moment when state intervention became necessary to try to reduce social inequalities.
