O combate às fake news e os limites da liberdade de expressão no estado democrático de direito

Abstract

Resumo: O fenômeno das fake news é um dos desafios enfrentados pela sociedade atual que sempre esteve presente na história da humanidade. Os efeitos nocivos das fake news violam direitos individuais e coletivos, afrontando a democracia e o Estado Democrático de Direito. A relevância desse fenômeno leva à necessidade do combate às fake news, unindo empresas privadas e instituições públicas na contenção da desinformação, principalmente nas redes sociais. A disseminação de fake news envolve o exercício da liberdade de expressão, direito que, muitas vezes, é utilizado como pretexto para a livre proliferação da desinformação. O presente trabalho busca analisar o fenômeno das fake news e os limites da liberdade de expressão no Estado Democrático de Direito, refletindo sobre o papel do Poder Judiciário para que a tutela jurisdicional não incorra em censura. Foi analisado o conceito de fake news e as suas repercussões sobre o Estado Democrático de Direito. O direito à liberdade de expressão e os seus limites foram investigados à luz da Constituição Federal de 1988 e da teoria geral dos direitos fundamentais. A atuação jurisdicional foi evidenciada sob a ótica da doutrina e da jurisprudência, com ênfase no Supremo Tribunal Federal. Este estudo concluiu que as fake news ensejam a intervenção do Poder Judiciário, que deve combatê-las após a ocorrência do exercício abusivo da liberdade de expressão, diante dos casos concretos, utilizando a técnica da ponderação de valores e observando os princípios da proporcionalidade, razoabilidade e proteção do núcleo essencial dos direitos fundamentais.

Abstract: Fake news phenomenon is one of the challenges faced by today's society that has always been present in human history. Fake news harmful effects violate individual and collective rights, affronting democracy and the Democratic State of Law. The result of this phenomenon leads to the need to combat fake news, uniting private companies and public institutions to contain disinformation, especially on social media. Fake news dissemination involves the exercise of freedom of speech, a right that is often used as a pretext for the free proliferation of disinformation. This paper seeks to analyze the phenomenon of fake news and the limits of freedom of speech in the Democratic State of Law, reflecting on the role of the Judiciary so that jurisdictional protection does not incur censorship. Fake news conception and its repercussions on the Democratic State of Law were analyzed. Freedom of speech and its limits were investigated in light of the Federal Constitution of 1988 and the general theory of fundamental rights. The jurisdictional action was evidenced from the perspective of doctrine and jurisprudence, with emphasis on the Federal Supreme Court. This study concluded that fake news leads to the intervention of the Judiciary, which must fight them after the abusive exercise of freedom of speech occurs, in concrete cases, using the technique of weighing values and observing the principles of proportionality, reasonableness and protection of the essential core of fundamental rights.
