Direito à moradia : refugiados como não detentores dos direitos fundamentais

Abstract

Resumo: O presente trabalho de graduação se dedica a explicar como os refugiados no Brasil devem ser detentores do direito à moradia, fundamentando tal afirmação na análise dos direitos humanos, do princípio da dignidade da pessoa humana e na equiparação dos refugiados para com os brasileiros natos no que se refere aos direitos fundamentais sociais. Para conseguir explicar o tema, no corpo do trabalho estarão presentes as leis brasileiras voltadas à proteção dos refugiados, bem como a explicação de que o direito à moradia é considerado direito fundamental à todos os seres humanos, da mesma maneira que estarão explicitados quais são os órgãos e medidas que existem no país com a finalidade, entre outras, de oferecer a moradia aos refugiados. Veremos que, para que o direito à moradia seja efetivado no país, é de suma importância a participação política do governo na criação de leis e na concretização de medidas que busquem construir e destinar moradias dignas para os que necessitam, baseando-se na ideia de que a moradia no Brasil tem um custo muito alto no qual grande maioria não consegue acessar. Além disso, a fim de entender o motivo da presente monografia existir, o trabalho mostrará as tristes consequências que a falta de moradia aos refugiados no país traz para eles, como a limitação de outros direitos que só existiriam caso estes conseguissem acessar uma moradia digna.

Abstract: This term paper is dedicated to explaining how refugees in Brazil should be owner to the right of housing, based on the analysis of human rights, the principle of human dignity and the equalization of refugees with native Brazilians in reference to fundamental social rights. To explain the theme there is a part in the term paper that will explain the Brazilian laws about protecting refugees, as well as an explanation that the right to housing is considered a fundamental right to all humans. Also explained will be the organizations and measures that exist in the country with their functions about to offer housing to refugees. We will be able to see in this term paper that for the right to housing to work in the country, the political participation of the government is important in the creation of laws and in the implementation of measures that work to build and give decent housing to those is in need based on the idea that access to housing in Brazil is something that can be considered a very high cost for part of the population, which means that most people cannot access. In addition in order to understand why this term paper exists, it will show the bad consequences that the homelessness of refugees in the country brings for them, such as the limitation of other rights that would only exist if they were able to access decent housing.
