Direito das pessoas com deficiência

Abstract

Resumo: Demonstrando a necessidade de incluir e diminuir as dificuldades das Pessoas com Deficiência, o trabalho apresentado buscou mostrar que a sociedade deve se atualizar, baseando nas leis atuais que abrangem um tratamento mais diferenciado e necessário para inclusão delas em interação com a sociedade. Contudo esses Direitos até 2015, eram precários no que se refere a essas pessoas com interação na sociedade, tanto, em ambientes públicos ou privados, não tinham um efetivo tratamento na sociedade em igualdade de condições com as demais pessoas. Sobre esse Direito que parece complexo, mas, não deveria, como observamos a legislação atual é bem efetiva e abrangente para conquista deles. Observando seu caráter histórico que, esse valor está arraigado na sociedade por conta da forma que as Pessoas com Deficiências eram tratadas na antiguidade e até pouco tempo atrás. Por fim, é demonstrado que os resultados que os principais grupos de classes que, buscam os Direito das Pessoas com Deficiência, dentre as principais as ONGs, que possui um papel de buscar garantias e direitos básicos de acessibilidade. Além disso, promovem a inclusão das Pessoas com Deficiência em áreas como educação, saúde, lazer e mercado de trabalho, contribuíram para a busca dessas conquistas de direitos atuais como demonstra o estudo. O Trabalho de Graduação corrobora através da Legislação de Direitos Internacionais que os Tratados e Convenções de Direitos Humanos obriga sua aplicabilidade no Brasil, através da Constituição de 1988 art. 5º, no seu parágrafo 3º, que foi importante para a efetividade de implementação de Leis especificas no ordenamento jurídico brasileiro, impondo o legislador pátrio a obrigação e aplicabilidade dos Tratados Internacionais no que se refere a legislação de Direitos Humanos.

Abstract: Demonstrating the need to include and reduce the difficulties of People with Disabilities, the work presented sought to show that society must update itself, based on current laws that cover a more differentiated and necessary treatment for their inclusion in interaction with society. However, these Rights until 2015, were precarious with regard to these people with interaction in society, both in public or private environments, they did not have an effective treatment in society on an equal basis with other people. About this law that seems complex, but should not, as we can see, the current legislation is very effective and comprehensive to conquer them. Noting its historical character, this value is rooted in society because of the way People with Disabilities were treated in antiquity and until recently. Finally, it is shown that the results that the main groups of classes that seek the Rights of Persons with Disabilities, among the main NGOs, which has a role to seek guarantees and basic accessibility rights. In addition, they promote the inclusion of People with Disabilities in areas such as education, health, leisure and the job market, contributing to the pursuit of these achievements of current rights, as the study demonstrates. The Graduation Work corroborates through the International Rights Legislation that the Human Rights Treaties and Conventions oblige their applicability in Brazil, through the 1988 Constitution art. 5, in its 3rd paragraph, which was important for the effectiveness of the implementation of specific Laws in the Brazilian legal system, imposing the national legislator the obligation and applicability of International Treaties with regard to Human Rights legislation.
