Proteção de dados e os impactos da LGPD nas instituições financeiras

Abstract

Resumo: A presente monografia tem o objetivo de analisar acerca da proteção de dados e os impactos que a Lei Geral de Dados causou nas instituições financeiras. A relevância do proposto se encontra na amostragem do avanço das leis de proteção às informações, bem como os impactos encontrados pelas Instituições financeiras para se adequar à Lei Geral de Proteção de Dados. É imprescindível o estudo da proteção de dados e sua conceituação, bem como a evolução histórica das leis que pertinentes à essa temática, trazendo para o âmbito nacional e mostrando o desenrolar e a aplicabilidade da LGPD. Anseia, também, em expor disparidades entre as várias formas de instituições financeiras bancárias e não bancárias, bem como as que se equiparam, e conceituá-las mostrando, assim, que todas elas são impactadas pela lei supramenciona. Elucidar os impactos que a implementação da lei pode causar das instituições, aglomerando algumas vertentes que pode acarretar a uma boa imagem da empresa ou a aluir a mesma. Constatando que mesmo que a LGPD foi um grande salto legislativo para a proteção de dados, não há uma garantia que será suficiente para que os indivíduos não tenham seus dados vazados, acarretando danos irreversíveis para a pessoa. Quanto à sistematização far-se-á o uso do método dialético; desenvolver-se-á o trabalho principalmente por meio de pesquisa bibliográfica e documental, em que serão utilizados os processos de identificação e compilação, bem como por intermédio de artigos científicos, doutrinas, leis em geral, dados obtidos em órgãos competentes.

Abstract: This monograph aims to analyze data protection and the impacts that the General Law of Data caused in financial institutions. The relevance of the proposal lies in the sampling of the advance of the laws for the protection of information, as well as the impacts found by financial institutions to adapt to the General Law of Data Protection. It is essential to study data protection and its conceptualization, as well as the historical evolution of the laws that pertain to this theme, bringing them to the national sphere and showing the development and applicability of the LGPD. It also seeks to expose disparities between the various forms of banking and non-banking financial institutions, as well as those that are equivalent, and to conceptualize them, thus showing that all of them are impacted by the aforementioned law. Elucidate the impacts that the implementation of the law may cause to the institutions, summarizing some aspects that may lead to a good image of the company or to its detriment. Noting that even though the LGPD was a great legislative leap for data protection, there is no guarantee that it will be enough for individuals not to have their data leaked, causing irreversible damage to the person. As for the systematization, the dialectical method will be used; the work will be developed mainly through bibliographic and documentary research, in which the processes of identification and compilation will be used, as well as through scientific articles, doctrines, laws in general, data obtained from competent bodies.
