Direito de propriedade garantido através do instituto da usucapião de bens imóveis e o princípio da função social da propriedade

Abstract

Resumo: No presente trabalho de graduação será analisado o direito de propriedade e sua evolução histórica no direito ao longo do tempo, com enfoque no direito brasileiro, garantido pelo art. 5º XXII da Constituição da Federal de 1988. O estudo realizado tem como objetivo interligar o direito de propriedade com o instituto da usucapião, trazendo em tópicos as modalidades e requisitos inerentes a cada uma. Para efetivação de tal garantia legal, o legislador positivou o princípio da função social da propriedade no rol dos direitos fundamentais, art. 5º XXIII da atual Carta Maior, desse modo, observou-se grande mudança conceitual acerca do direito de propriedade, agora não mais sendo um direito individualista e absoluto,dando lugar, a características sociais em prol da sociedade e do meio ambiente. De acordo com esse novo entendimento, o dono imóvel deve exercê-lo em favor da coletividade sob risco de perda da propriedade. Os capítulos serão divididos entre, direito de propriedade, princípio da função social, usucapião e julgados acerca do tema central.

Abstract: This paper will evaluate property rights and their historical evolution, judicially, over time, focusing on Brazilian law, guaranteed by article XXII of the Federal Constitution of 1988. The objective of this paper is to link the right of property with the establishment of Adverse possession, respectively conveying for each topic the representations and requisites. For the conception of this legal guarantee, the official avowed the idea of the social function of property on the list of fundamentals, article 5º XXIII of the current Major Charter, thus observing a large change conceptually to the right to property, now not being an individualistic and absolute right, setting in place social characteristics in favor of society and the environment. In accordance to this new understanding, the property owner must follow it in favor of the collective or risk losing the property. The chapters will be divided between, property rights, conception of social function, Adverse possession and the rulings on the main theme.
