Lei Maria da Penha : reflexões

Abstract

Resumo: O estudo acadêmico tem por objetivo analisar as reflexões trazidas na Lei n° 11.340, de 07 de agosto de 2006, formalmente conhecida como Lei Maria da Penha, buscando trazer a origem da proteção há mulher em seu âmbito familiar, através da luta não só da Maria da Penha, causadora do crescimento de tamanha visibilidade, mas para com toda representatividade feminina, lutando contra a desigualdade e o padrão que a sociedade brasileira enraíza da mulher como submissa de sexo masculino, buscando a segurança contra a violência causada em seu domicilio. Desde o motivo pelo qual se tornou tão popular pela visão submissa que a mulher obtinha antigamente, até o presente ano com todo seu crescimento evolutivo. A Lei vem tendo uma exorbitante representatividade, tanto em nosso ordenamento jurídico, como em nossa sociedade num todo. Com grandes mudanças na segurança das mulheres, tem visualizado a importância dessa representação, pois veio com o desígnio de represar a violência doméstica e familiar contra a mulher. Portanto, o trabalho vem apresentar primeiramente a origem histórica, contando a trajetória da Maria da Penha, abordando as tipificações de violência que são afetadas e enraizadas na Lei, além das Medidas Protetivas estabelecidas á proteção e repressão das mulheres vítimas de violência doméstica e familiar.

Abstract: The academic study aims to analyze how reflexes brought in Law No. 11,340, of August 7, 2006, formally known as Maria da Penha Law, seeking to bring a source of protection to women in their family members, through the struggle not only of Maria da Penha, causing future visibility growth, but with all female representation, fighting against inequality and the pattern that the Brazilian society of women as male submissive, seeking security against female violence in her home. From the reason why it became so popular for the vision that submits a woman obtained formerly, until the present year with all its evolutionary growth. The Law has had an exorbitant representativeness, both in our legal system and in our society as a whole. With major changes in women's safety, she sees the importance of this representation, as it comes with the design of representing domestic and family violence against a woman. Therefore, the presented work presents the historical origin, telling a trajectory of Maria da Penha, approaching as typifications of violence that are affected and rooted in the Law, besides the applied Protective Measures of protection and repression of women victims of domestic and family violence.
