Mutação constitucional e o ativismo judicial no Supremo Tribunal Federal

Abstract

Resumo: A pesquisa que segue é um Trabalho de Graduação (TG) para a obtenção de título de bacharel em Direito. Ela busca esmiuçar a mutação constitucional e o ativismo judicial no Supremo Tribunal Federal, que se apresentam como sendo fenômenos jurídicos. A mutação constitucional pode ser entendida como a modificação do entendimento sem que haja mudança no texto legal, e, por sua vez, o ativismo judicial tem sua importância demarcada pela história, nos Estados Unidos, por exemplo, onde surgiu pela primeira vez tal termo, a Suprema Corte tem sido um exemplo de como o Poder Judiciário é influenciado e influencia a política, e, não menos importante mas no Supremo Tribunal Federal tanto no âmbito do controle abstrato (concentrado) ou concreto (difuso), através da discussão acerca do art. 52, X da Constituição Federal, muito têm se falado e discutido academicamente quanto ao papel do Pretório Excelso com relação as suas decisões que repercutem por toda a sociedade e também causam discussões no âmbito jurídico. O presente trabalho elucida a historicidade de tais fenômenos através da metodologia de pesquisa baseada no método dialético, por meio de pesquisa bibliográfica e documental, em que serão utilizados os processos de identificação e compilação, bem como por intermédio de artigos científicos, jurisprudências, dados obtidos em órgãos competentes e doutrinas. Através dos capítulos que seguem se concluiu que o papel institucional do Supremo Tribunal Federal é o basilar de defensor da Constituição, mas algumas vezes exacerbadamente a Suprema Corte acaba por exercer poderes que não são inerentes à ela, devido a judicialização da vida e, outras vezes, aos interesses subjetivos dos Ministros.

Abstract: The research that follows is undergraduate work (TG) to obtain a bachelor's degree in law. It seeks to scrutinize constitutional change and judicial activism in the Federal Supreme Court, which appear to be legal phenomena. Constitutional change can be understood as a change of understanding without changing the legal text, and in turn judicial activism has its importance demarcated by history in the United States, for example, where such a term first appeared, The Supreme Court has been an example of how the judiciary is influenced and influences politics, and not least but in the Federal Supreme Court both within the scope of abstract control - concentrated or diffuse - through the discussion of art. 52, X of the Federal Constitution, much has been said and discussed academically about the role of Pretorio Excelso in relation to its decisions that have repercussions throughout society and also cause discussions in the legal field. The present work elucidates the historicity of such phenomena through the research methodology based on the dialectical method, through bibliographic and documentary research, in which the identification and compilation processes will be used, as well as through scientific articles, jurisprudence, data obtained. in competent bodies and doctrines. The following chapters have concluded that the institutional role of the Federal Supreme Court is the fundamental defender of the Constitution, but sometimes the Supreme Court exercises powers that are not inherent to it, due to the judicialization of life, and sometimes , to the subjective interests of Ministers.
