A reforma do processo canônico para as causas de nulidade do matrimônio

Abstract

Resumo: O presente trabalho tem como foco a apresentação da reforma do processo de nulidade matrimonial feito pelo Papa Francisco no ano de 2015 através da Carta Apostólica Mitis Iudex Dominus Iesus, bem como a comparação dos cânones que foram revogados com os novos cânones, as novas diretrizes para este tipo de procedimento e as novidades trazidas por esta legislação. Num primeiro momento apresenta-se uma introdução à própria Ciência Canônica, suas fontes, desenvolvimento e características para que os leitores possam compreender a relação do direito com a Igreja Católica. Num segundo momento, é realizada a introdução de elementos e institutos do direito processual canônico para se ter uma visão geral do processo no âmbito da Igreja, seus institutos, os meios de prova, a hierarquia judicial da Igreja bem como partes e procuradores e, por fim, é apresentada a Reforma promulgada no ano de 2015 pelo Romano Pontífice, analisando-se cânon por cânon.

Abstract: The present work focuses on the presentation of the reform of the matrimonial nullity process made by Pope Francisco in the year 2015 through the Apostolic Letter Mitis Iudex Dominus Iesus, as well as the comparison of the canons that have been revoked with the new canons, the new guidelines for this type of procedure and the innovations brought by this legislation. In the first moment an introduction to Canonical Science itself, its sources, development and characteristics is presented so that the readers can understand the relation of the right with the Catholic Church. Secondly, the introduction of elements and institutes of canonical procedural law is carried out in order to have an overview of the process within the Church, its institutes, the means of proof, the judicial hierarchy of the Church as well as parties and procurators. Finally, the Reform promulgated in the year 2015 by the Roman Pontiff is presented, and canon by canon is analyzed.
