A Responsabilidade Civil decorrente do abandono afetivo

Abstract

Resumo: A pesquisa visa demonstrar a possibilidade de pleitear indenização diante do abandono afetivo gerado pelos pais em face da criança, visto que não há previsão legal no ordenamento jurídico sobre a possibilidade de exigir seu cumprimento, no entanto, a Constituição Federal de 1988 determina que ambos os genitores têm o dever de cuidar de sua prole, não só com sustento material, mas sim com afeto e a atenção. Nesse sentindo, mostra-se importante sua apreciação por ser uns dos temas mais controversos no Direito das Famílias, além de existir diversos casos atualmente em que geralmente a prole é abandonada por um dos seus genitores. O estudo aborda, também, sobre as consequências psicológicas ocasionadas em decorrência do abandono afetivo, assim como a importância do afeto na formação psíquica do menor. Por fim, com objetivo específico de analisar a real finalidade da responsabilidade civil decorrente do desamor, serão estudados e expostos os recentes julgados que versaram sobre a aplicação ou não da responsabilidade civil em casos concretos, do mesmo modo, serão apresentados os Projetos de Lei que tramitam no Congresso Nacional para regulamentar o abandono moral. O presente estudo utilizou-se de pesquisas documentais e bibliográficas especializadas que tratam sobre o assunto de forma geral, bem como artigos científicos e informativos de órgãos competentes.

Abstract: The research aims to demonstrate the possibility of plead compensation for the emotional abandonment generated by parents in the face of the child, since there is no legal provision in the legal system on the possibility of demanding compliance, however, the Federal Constitution of 1988 determines that both Parents have the obligation to care for their offspring, not only with material sustenance, but with affection and attention. In this sense, its appreciation is important because it is one of the most controversial topics in Family Law, in addition to existing several cases currently in which the offspring is usually abandoned by one of its parents. The study approach, also, the psychological consequences caused by emotional abandonment, as well as the importance of affection in the psychological formation of the minor. Finally, with the specific objective of analyzing the real purpose of civil liability arising from the lack of love, the recent judgments that dealt with the application or not of civil liability in specific cases will be studied and exposed, likewise, will be presented the law project that are process in the National Congress to regulate moral abandonment. The present study used specialized documentary and bibliographic researches that treat about the subject of way general, as well as scientific and informative articles from competent organ.
