O processo de adoção no Brasil : a longa gestação de um filho do coração

Abstract

Resumo: Este trabalho tem como objetivo estudar o processo de adoção no Brasil, abordando suas peculiaridades, seu histórico, as modalidades existentes, a legislação pertinente, as razões que levam alguém a adotar, bem como os caminhos que precisam ser trilhados para se alcançar o tão almejado sonho, que faz parte do imaginário das crianças e adolescentes, geralmente institucionalizados em razão do abandono da família natural. O trabalho foi desenvolvido a partir de vasta pesquisa bibliográfica, com o fim de apresentar ao leitor, ainda, o problema da morosidade no desenvolvimento do processo, considerando, inclusive, a questão da insistência dos operadores do Direito na reinserção do infante em família consanguínea, quando já não há possibilidade de sucesso, bem como a discussão acerca dos cuidados atinentes à destituição do poder familiar, que podem inviabilizar o acolhimento do infantojuvenil em família substituta, se não for processada em tempo hábil. A fim de contornar os entraves descritos, estudou-se as alternativas possíveis para conscientizar a sociedade de sua responsabilidade e das possibilidades para promover o acolhimento afetivo de forma a garantir a proteção integral da criança e do adolescente.

Abstract: This work aims to study the adoption process in Brazil, addressing its peculiarities, its history, the existing types, the relevant legislation, the reasons that lead someone to adopt, as well as the paths that need to be followed to achieve the long-awaited dream, which is part of the imagination of children and adolescents, usually institutionalized due to the abandonment of the natural family. The work was developed from a vast bibliographical research, in order to present to the reader, still, the problem of the delay in the development of the process, considering, also, the question of the insistence of the Law operators in the reinsertion of the infant in a consanguineous family, when there is any possibility of success, as well as the discussion about the care related to the removal of family power, which can make the reception of children and adolescents in a foster family unfeasible, if not processed in a timely manner. In order to circumvent the obstacles, study as possible alternatives to make society aware of its responsibility, of the possibilities to promote affective care in order to protect the full protection of children and adolescents.
