A responsabilidade civil nos casos de pornografia de vingança

Abstract

Resumo: O presente estudo visa expor e debater os reflexos da pornografia de vingança no ordenamento jurídico brasileiro. Com o advento da internet, surgiram novas modalidades de comportamentos perniciosos, sendo o revenge porn um dos mais frequentes na atualidade. A conduta de expor vídeos ou fotografias íntimas de outrem pode prejudicar todas as áreas de sua vida, seja no âmbito familiar, no ambiente de trabalho ou até mesmo a própria saúde mental daquele que é exposto. Há inúmeros exemplos de casos em que as pessoas expostas, geralmente mulheres, chegam a tomar atitudes extremas, como o suicídio, para evitar todo o constrangimento de se ver tão exposta. Entendendo a relevância do tema na atualidade, como base da pesquisa serão apresentados os conceitos de responsabilidade civil, estudo de casos reais e ainda qual o tratamento dispensado pela lei neste momento para resguardar os direitos das vítimas e punir os agressores, visto que a exposição de conteúdo íntimo na internet pode causar danos irreparáveis. Após a construção da pesquisa, a conclusão objetiva determinar se a lei atende às expectativas atuais ou se com as mudanças sociais apresentadas, faz-se indispensável uma atualização.

Abstract: This study aims to expose and debate the effects of revenge pornography on the Brazilian legal system. With the advent of the internet, new forms of pernicious behavior have emerged, revenge porn being one of the most frequent today. The conduct of exposing videos or intimate photographs of others can harm all areas of your life, whether in the family environment, in the work environment or even the very mental health of the one who is exposed. There are countless examples of cases in which exposed people, usually women, take extreme actions, such as suicide, to avoid all the embarrassment of being so exposed. Understanding the relevance of the topic today, as a basis for the research, the concepts of civil liability, the study of real cases will be presented, as well as the treatment given by the law at this moment to safeguard the rights of victims and punish aggressors, since the exposure of Intimate content on the internet can cause irreparable harm. After the construction of the research, the conclusion aims to determine whether the law meets current expectations or whether with the social changes presented, an update is essential.
