A multiparentalidade e seus efeitos no direito sucessório

Abstract

Resumo: O presente trabalho tem como objetivo analisar o instituto da multiparentalidade, que permite a cumulação das paternidades de ordem biológica e socioafetiva, fazendo com com um único filho possua mais de dois pais. Haverá exposição da evolução histórica da composição da família, bem como dos princípios norteadores da família multiparental. Ainda, serão expostos os seus nuances no Direito das Famílias e Direito das Sucessões, e questionadas suas atuais incógnitas, de forma a também apresentar possíveis soluções.

Abstract: The present work aims to analyze the multiparentality institute, which allows the cumulation of biological and socio-affective paternity, making a single child have more than two parents. There will be an exhibition of the historical evolution of the composition of the family, as well as the guiding principles of the multiparental family. Also, their nuances in Family Law and Succession Law will be exposed, and their current unknowns will be questioned, in order to also present possible solutions.
