Leilões judiciais e extrajudiciais sob a égide dos bens imóveis

Abstract

Resumo: O presente trabalho buscou transmitir de forma prática o conhecimento necessário para aqueles que buscam solucionar as situações embaraçosas que o mundo dos leilões de imóveis vos apresenta. Oferecendo instruções para que a imposição da lei ocorra de modo a respeitar a dignidade de quem, de forma voluntária ou involuntariamente, viu seu patrimônio ser afetado por ação de estranhos que agem em nome de uma abstração, via poder judiciário ou não. Distinguindo as modalidades dos leilões, detalhando os procedimentos, á luz das leis em vigor, em especial do Decreto 21.981 (BRASIL, 1932), que regulamenta a atividade de leiloaria no território nacional. Conceituando, a natureza jurídica dos leilões e suas nuances, a responsabilidade civil e criminal dos leiloeiros, jurisprudências no nosso poder judiciário.

Abstract: The present work sought to convey in a practical way the necessary knowledge for those who seek to solve the embarrassing situations that the world of real estate auctions presents to you. Offering instructions for the imposition of the law to occur in a way that respects the dignity of those who, voluntarily or involuntarily, saw their patrimony being affected by the action of strangers who act in the name of an abstraction, via the judiciary or not. Distinguishing the modalities of the auctions, detailing the procedures, in the light of the laws in force, especially Decree 21.981/32, which regulates the auction activity in the national territory. Conceptualizing the legal nature of auctions and their nuances, the civil and criminal liability of auctioneers, jurisprudence in our judiciary.
