A eficácia da função social da propriedade na usucapião

Abstract

Resumo: No presente trabalho de Graduação será abordado a eficácia da função social da propriedade, bem como sua evolução histórica, com principal direcionamento ao direito brasileiro, com fundamentação principalmente na Constituição Federal de 1988 e no Código Civil de 2002. A propriedade em si sofreu alterações em seu conceito e que será demonstrado como ao longo do tempo se tornou algo coletivo a se comparar aos antigos povos. O principal objetivo deste trabalho visa associar o princípio da função social, esculpido nos direitos fundamentais e expresso como cláusula pétrea pela Constituição, com a usucapião. Desse modo, é demonstrado como a usucapião só se faz possível a partir de requisitos e pressupostos que o indivíduo tem que obter para pleitear esta ação, e estes são baseados e se fazem imprescritíveis, principalmente no tocante à função social que há de se demonstrar para com a propriedade. Os capítulos serão divididos e abordados entre a propriedade, com enfoque histórico e como a evolução se faz presente atualmente, a função social da propriedade, demonstrando sua importância para com a ação de usucapião e, derradeiramente, sobre a usucapião, acerca de algumas modalidades e julgados demonstrando o efetivo cumprimento dos requisitos para ser possível.

Abstract: In the present Graduation work, the effectiveness of the social function of property will be approached, as well os its historical evolution, with main direction to Brazilian law, based mainly on the Federal Constitution of 1988 and the Civil Code of 2002. The property itself underwent changes in its concept and it will be shown how over time it has become something collective to be compared to ancient peoples. The main objective of this work is to associate the principle of social function, carved in fundamental rights and expressed as a stony clause by the Constitution, with Usucaption. In this way, it is demonstrated how adverse possession is only possible from requirements and assumptions that the individual has to obtain to claim this action, and these are based and become imprescriptible, especially with regard to the social function that must be demonstrated the property. The chapters will be divided and discussed between the property, with a historical focus and how the evolution is currently present, the social function of the property, demonstrating its importance to the action of Usucaption and, finally, about Usucaption, some modalities and judgeds demonstrating effective fulfillment the requirements for to be possible.
