Responsabilidade civil nos contratos de transporte de cargas

Abstract

Resumo: O presente trabalho de graduação tem por escopo a análise da responsabilidade civil dos contratos de transporte de carga, pela ótica do Código Civil de 2002, assim como das demais legislações especiais que tratam a respeito do tema. Haja vista a diversa ótica a respeito do tema pelos doutrinadores, Tribunais e legislações, visando a definição exata da responsabilidade civil dos transportadores de carga, ainda sim, objetificando a segurança jurídica entre particulares e a responsabilidade aquiliana que abarca o assunto. A era contemporânea apenas se estabeleceu da forma vista atualmente, perante o grande avança sócio-histórico dos transportes em seus mais diversos modais.

Abstract: The scope of this undergraduate work is to analyze the civil liability of cargo transportation contracts, from the perspective of the 2002 Civil Code, as well as other special legislation that deals with the topic. Considering different perspectives on the subject held by scholars, courts and legislation, aiming at the exact definition of the civil liability of cargo carriers, yet objectifying legal certainty between individuals and the aquilian responsibility that covers the subject. The contemporary era only established itself in the form seen today, in the face of the great socio-historical advance of transport in its most diverse modes.
